By accessing and using FYND's cybersecurity services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you must not use our services.

Service Description

FYND provides cybersecurity services including vulnerability scanning, monitoring, dark web intelligence, reporting, and recommendations.

Our services are designed to help organisations identify, assess, and manage security risks effectively.

We may use analytics and monitoring technologies, such as Microsoft Clarity and Google Analytics, to measure usage and improve service performance and security.

External Scans

FYND's vulnerability assessments are limited to external, non-intrusive scans that analyse publicly visible information about your domain and associated systems.

These scans do not involve penetration testing, exploitation of vulnerabilities, or access to private/internal systems.

You should expect findings such as outdated software versions, misconfigured services, exposed ports, and other publicly observable risks.

Reports generated are intended to highlight potential security issues for your awareness and remediation. They do not guarantee a complete assessment of all risks.

FYND's services are purely diagnostic in nature — we identify and report vulnerabilities but do not perform remediation, patching, or configuration changes. Detection does not imply that an issue has been fixed or mitigated. It remains your responsibility to act upon the findings and implement appropriate security measures.

Because cybersecurity landscapes evolve rapidly, vulnerabilities can appear or disappear between scans. If you choose a monthly or other periodic scan schedule, you acknowledge that new risks may emerge between scan cycles, and FYND cannot be held responsible for vulnerabilities discovered outside the agreed scanning frequency.

Rights of Use

FYND grants you a limited, non-exclusive, non-transferable right to access and use our services for your own internal business purposes.

You must not attempt to copy, reverse engineer, or otherwise interfere with the operation of our services, nor use them to develop competing products.

Your use of our services must comply with all applicable laws, regulations, and these Terms.

Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms.

You must not attempt to gain unauthorised access to our systems, interfere with service security or availability, or use our services to scan websites you do not own or have explicit permission to test.

You must not introduce viruses, malicious code, or otherwise disrupt the integrity of our services.

Customer Data and Privacy

By using our services, you grant FYND the right to process data you provide solely for the purpose of delivering the services and fulfilling our contractual and legal obligations.

All personal data is stored within the European Union and processed in accordance with the UK GDPR and applicable data protection laws.

We will not sell or share your data with third parties for marketing purposes without your explicit consent.

User Responsibilities

You are responsible for ensuring the accuracy of the information you provide, maintaining the confidentiality of your account credentials, and notifying us promptly of any unauthorised use of your account.

You must ensure you have the necessary authorisations to perform scans or assessments and that your use of the services complies with applicable laws.

You acknowledge that FYND's reports and recommendations are advisory in nature. Implementation of fixes and mitigation measures remains your responsibility. FYND does not assume liability for any breach, compromise, or damage that occurs even after a scan or report has been delivered.

Service Availability

We strive to maintain reliable and continuous access to our services, but we cannot guarantee uninterrupted availability. Scheduled maintenance or unforeseen issues may cause temporary downtime. We will provide notice of planned maintenance when reasonably possible.

Warranties and Disclaimers

FYND provides services on an 'as is' and 'as available' basis. While we use reasonable skill and care, we do not guarantee that all vulnerabilities will be detected or that services will be error-free. To the maximum extent permitted by law, we exclude all implied warranties.

FYND expressly disclaims any liability for security incidents, breaches, or hacks that occur on your systems before, during, or after the use of our services. Our scans provide visibility and recommendations but do not prevent, block, or mitigate attacks in real time. Performing a scan does not guarantee that your systems are secure or that vulnerabilities have been remediated. You remain solely responsible for applying patches, configuration changes, and other fixes.

Limitation of Liability

Our total liability arising under these Terms, whether in contract, tort, or otherwise, shall not exceed the total fees paid by you for the services in the twelve months preceding the claim. We shall not be liable for indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities.

Termination

We may suspend or terminate your access to the services immediately if you breach these Terms, fail to make required payments, or engage in conduct that could harm our systems, services, or reputation. Upon termination, your rights to use the services will cease immediately.

Changes to Terms

We may update these Terms of Service from time to time. Significant changes will be notified in advance where reasonably practicable. Your continued use of our services after changes are published constitutes your acceptance of the revised Terms.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any disputes arising in connection with these Terms.
